Terms of Service
Last updated: {{LAST_UPDATED}}
The short version
These terms are the agreement between you and us when you use tinytownrugs.com or buy a rug. The full terms below are what count, but these are the parts that matter most:
- You pay when you order. We then design your rug and email you a proof. Nothing is printed until you approve it.
- Love your design or your money back. If you can't approve your proof, you get a full refund. You can also cancel for a full refund at any time before you approve it.
- Once you approve your proof, your rug is made just for you, so we can't take it back because you changed your mind. We will put things right if it arrives faulty or damaged, or if we made a mistake.
- Your rug is an illustration of your town, designed with the help of AI. It's a picture made for play, not a map, and buildings are simplified, so they won't match real life exactly.
- The proof you approve is what we print. Please check it carefully, especially the spelling of names.
- Only send us photos and names you're allowed to use.
- We can turn down any order. If we do, you get all your money back.
- The rug is yours to enjoy. Please don't copy the artwork onto other products or sell it.
- We won't show your rug in our marketing unless you say yes.
1. Who we are and what these terms cover
TinyTown Rugs is run by Beachy Dreams, LLC ("TinyTown Rugs", "we", "us" or "our"), {{BUSINESS_ADDRESS}}. You can reach us at hello@tinytownrugs.com.
These terms apply when you use our website, tinytownrugs.com, or order a rug. By doing either, you agree to these terms and to the policies that are part of them:
- Privacy Policy: what information we collect and what we do with it
- Refunds, Reprints and Cancellations
- Shipping
- Care and Safety
If you don't agree, please don't use the site.
You must be at least 18 years old, and old enough to enter into a binding contract where you live, to place an order. We only sell to customers with a shipping address in the United States.
2. How it works
- You browse our example rugs to see the styles.
- You fill in our order form: your town, a business or a school; the style you'd like (Nostalgic or Modern); any places you'd like on the rug; and, if you like, photos, for example of a favorite local place.
- You choose a size and pay the full price at checkout through Stripe, our payment provider. You give us your email address so we can send you your proof and keep you updated.
- We look up public information and photos of the places in your town, design your rug with the help of AI, and email you a proof, usually the same day and within 2 business days at most.
- You look at your proof on our website, and either approve it or ask for changes. If you ask for changes, we make them and send you a new proof.
- Once you approve your proof, our print partner makes your rug and ships it to you.
3. Our proof promise, and why every rug is made to order
- Nothing is printed until you approve your proof.
- Love your design or your money back. If you can't approve your proof, tell us, and we'll refund everything you paid before anything is printed.
- You can cancel for a full refund at any time before you approve your proof.
- After you approve, your rug is made just for you. It's a one-of-a-kind design that nobody else could use, so we can't accept returns or exchanges because you changed your mind, chose the wrong size, or would like a different design. Please check your proof and your rug size before you approve.
- If your rug arrives faulty or damaged, or we got something wrong, we'll reprint it or refund you. Our Refunds policy has the details.
4. What your rug is, and what it isn't
Your rug is an artistic interpretation of your town, made with the help of artificial intelligence (AI). It's designed for play, in the style of a classic children's road rug. Please keep these points in mind:
- It isn't a map. The roads are a play layout, not your real streets. Places aren't drawn to scale or in their true positions, and distances and directions aren't accurate. Please don't use your rug to find your way anywhere.
- Buildings are approximate. We show real landmarks as simple, friendly shapes. Their colors, shapes, sizes and details are simplified and will differ from the real buildings, sometimes noticeably.
- We choose what goes on it. We pick a handful of places that suit a play rug, and we may leave out, combine or move places to make a better design. Every rug also includes a few favorites, such as a fire station, a police station and a school. A school we choose for you is labeled simply "School"; a school you ask for by name keeps its name.
- Research can be wrong. We use public information and photos to work out what each place looks like, but sources can be out of date or mistaken, and AI makes mistakes. Where we couldn't find out what a place looks like, it may be designed from a general description.
- The examples are examples. The example rugs on our site show our styles. Your rug is designed fresh for your town, so it won't look exactly like any of them.
- No endorsement. A town, school, business or landmark appearing on a rug doesn't mean it endorses, sponsors or is connected with TinyTown Rugs, and we aren't connected with it.
So a rug that differs from real life in these ways isn't faulty. Your proof shows you exactly what your rug will look like, and nothing is printed until you approve it.
5. Proofs, changes and the final design
- Your proof. We'll email you when your proof is ready, and you'll look at it on our website. Proofs may carry a watermark and be shown smaller than the print. Please don't remove the watermark or use a proof for anything except checking your rug.
- Changes. If you'd like something changed, tell us when you look at your proof, and we'll send you a new one. There's no fixed number of rounds: we're happy to keep making reasonable changes, but whether we can make a particular change is our decision. AI doesn't always follow instructions exactly, and a change can affect other parts of the picture, so we can't promise every change is possible. If we can't make a change you'd like, we'll tell you, and you can approve your latest proof or have a full refund.
- The printed rug is the proof you approve. We print the version you approve, without any watermark, enlarged to the size of your rug. We don't redraw it.
- Check your proof carefully, especially the spelling of names. Once you approve it, your rug goes into production and can't be changed.
- Screens and fabric look different. Your rug is printed on chenille, a soft, textured fabric. Colors usually look a little softer than on a screen, and very fine details are less crisp.
- The edges are trimmed. A thin strip around the outside of the artwork is trimmed off when the rug is made, and the two sizes are slightly different shapes, so a little more or less of the edges may show. That's why designs leave open space around the outside and keep names and important places away from the edges.
- Our checks. We check the print file before your rug is printed. If we notice a problem, we'll tell you. We won't change your approved design without your OK.
- If we don't hear from you. We'll send you a reminder if you haven't replied to a proof. If {{PROOF_WAIT_DAYS}} days pass after we send a proof and we still haven't heard from you, we'll cancel your order and refund you in full, because we never print a rug you haven't approved.
6. Photos, names and other things you send us
To make your rug, you may send us text, such as your town, the names of schools, businesses or other places, and the changes you'd like, and photos. In these terms we call all of this "your content".
When you send us your content, you confirm that:
- you took the photos yourself, or you have permission from whoever owns them to use them this way;
- you have the right to ask us to put the names, places and anything else in your content on a rug (for example, it's your own home, or a public place, business or school that you're simply naming);
- anyone who can be identified in a photo has agreed to it being used (we only need buildings and places, so it's best to leave people out, especially children);
- your content isn't illegal, offensive or misleading, and doesn't infringe anyone's copyright, trademark, privacy or other rights.
About trademarks. Business and school names, logos and mascots can be trademarks that belong to someone else. We include names to describe real places in your town. We may simplify or leave out logos, mascots and official seals, and we may decline a design that uses someone else's brand in a way that could suggest they made, sponsored or approved the rug. If you ask for your own business, you confirm that you're allowed to use its name and branding.
Your content stays yours. You give us permission to use it, and to let the service providers listed in our Privacy Policy use it, only to make your rug, fill your order, help you, keep the service secure, and meet our legal obligations. That permission ends when your content is deleted as our Privacy Policy describes.
7. Rugs we won't make, and orders we may cancel
A person makes every rug, and we may decline any order. In particular, we won't make designs that:
- are hateful, harassing, sexual or violent, or otherwise offensive or unsuitable for a children's rug;
- target or mock a private person, or reveal private information about them, such as someone else's home without their permission;
- use someone else's photos, artwork or trademarks without permission, or otherwise infringe their rights;
- are illegal, or would help someone break the law.
We may also limit, suspend or stop anyone's use of the site, and cancel any order, if we reasonably believe the service is being misused. For example:
- using bots, scripts or other automated tools, or trying to get around our bot check;
- copying, scraping or reselling our proofs, our designs or our example rugs;
- trying to break into, disrupt or overload the site;
- fraud, such as using a payment card without the cardholder's permission;
- being abusive or threatening toward us.
We may also cancel an order if we can't make or deliver it, for example because the address can't be delivered to.
If we cancel an order you've paid for, we'll refund everything you paid, including tax, to your original payment method.
8. Prices, payment and tax
- Prices are in US dollars and include shipping to US addresses. There's no separate shipping charge.
- You pay the full price when you order. Sales tax is calculated at checkout based on your shipping address and added to your total.
- Payments are handled by Stripe. We never see or store your full card number.
- Your order is accepted when we email you an order confirmation. If there's a problem with your payment, we'll let you know.
- If we find that the price you paid was wrong because of an error, we'll contact you before your rug is printed, and you can choose to go ahead at the correct price or cancel for a full refund. If the correct price is lower, we'll refund the difference.
- We may change our prices at any time. A change never affects an order you've already placed.
9. Making and delivering your rug
After you order, we make your proof. Once you approve it, our print partner makes your rug and it's shipped to the address you gave at checkout. Our Shipping policy explains how long this takes, how tracking works, and what happens if your order is delayed.
Please make sure your shipping address is correct. We can't be responsible for a rug sent to a wrong address you gave us, though we'll do what we can to help, as our Shipping policy explains.
10. Cancellations, refunds and reprints
You can cancel your order for a full refund at any time before you approve your proof, and if you can't approve your proof, you get a full refund. After you approve it, your rug is being made just for you and can't be canceled, except if your order is delayed, as our Shipping policy explains.
If your rug arrives faulty or damaged, or we made a mistake, tell us within 30 days of delivery and we'll reprint it or refund you. Our Refunds policy has the details.
11. Who owns the artwork, and how you may use it
Once it's delivered, the rug itself is yours. The artwork on it works a little differently:
- We, or the people we license from, own whatever rights exist in the artwork, our designs, layouts and styles, and the website. (Artwork made with AI may not be protected by copyright in the same way as artwork drawn entirely by hand; these terms cover whatever rights there are.)
- We give you a personal, non-exclusive license to enjoy the artwork as part of your rug: to use and display the rug at home, or at your own premises if you ordered for a business or school, and to take photos and videos of your rug and share them anywhere, including on social media.
- If you give away or sell the rug itself, its new owner may use it in the same way.
- Without our written permission, please don't copy the artwork onto other products or prints, sell or license the artwork, or use the artwork itself in advertising. Photos of your rug in use are fine.
Your own photos and other content stay yours (see section 6).
12. We won't use your design in our marketing without asking
We'd love to show off the rugs we make, but your design is personal to you. We won't use your design, your photos or pictures of your rug in our advertising, or show them publicly on our website or social media, unless you give us permission.
If you do give permission, you can change your mind at any time by emailing us. We'll then take your design down from our website and social media accounts and won't use it in anything new.
13. Using the website
- We use your email address to sign you in to see your order and your proofs, so please keep your email account and your devices secure.
- We may change, pause or stop any part of the site.
- Some parts of the service are provided by other companies, such as Stripe for payments. Their own terms may apply to what they do.
- We may link to other websites for convenience. We're not responsible for them.
14. Our promise, and its limits
We stand behind every rug: you only pay for a rug whose proof you've approved, and if it then arrives faulty or damaged, or we made a mistake, we'll make it right, as our Refunds policy describes.
The website, research and AI tools are provided "as is" and "as available". To the fullest extent the law allows, we don't promise that the site will always be available or free of errors, or that our research or AI will be accurate, complete or produce any particular result.
Nothing in these terms takes away rights you have under laws that can't be changed by agreement, including consumer protection laws.
15. Limits on our liability
To the fullest extent the law allows:
- we aren't liable for indirect, incidental, special or consequential losses, such as lost profits or lost data, arising from your use of the site or a rug, even if we knew they were possible;
- our total liability for any claim connected with an order is limited to the amount you paid for that order, and for any other claim to US$100.
These limits don't apply to liability that the law doesn't allow us to limit, for example for death or personal injury caused by our negligence, or for fraud. Some states don't allow some of these limits, so they may not all apply to you.
16. If someone makes a claim about your content
If someone makes a claim against us because content you sent us broke these terms or infringed their rights (for example, a photo you didn't have permission to use), you agree to cover our reasonable costs and losses from that claim, including reasonable legal fees, as far as the law allows.
17. If something goes wrong between us
Please talk to us first. Most problems can be sorted out quickly by email at hello@tinytownrugs.com. If we can't resolve something within 30 days, either of us may take it further.
These terms, and any dispute about them, the site or a rug, are governed by the laws of the State of North Carolina and applicable US federal law, without regard to conflict-of-law rules. Any court case must be brought in the state or federal courts located in or serving {{VENUE_COUNTY}} County, North Carolina, and we both agree to those courts' jurisdiction. Either of us may instead bring a claim in small claims court in the county where you live, if the claim qualifies.
This doesn't take away any protection you have under the consumer laws of the state where you live.
18. Changes to these terms
We may update these terms from time to time. When we do, we'll change the "Last updated" date at the top, and if a change is significant we'll tell you by email or on the site. The terms in force when you place an order apply to that order.
19. The small print
- These terms, together with the policies linked above, are the whole agreement between you and us about the site and your order.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- You may not transfer your rights under these terms to someone else, apart from giving or selling the rug itself (see section 11). We may transfer ours, for example if the business is sold, and these terms will still protect you.
- We're not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, carrier problems or outages at our suppliers. If one delays your order, we'll still keep you informed and give you the choice to cancel, as our Shipping policy explains.
- We'll communicate with you by email. Emails we send you, and the choices you confirm on the site, such as approving your proof, count as being "in writing".
